- 集体土地征收补偿已成为土地征收制度的核心问题，我国目前集体土地征收补偿中存在公共利益不明确、补偿机制不合理、征收程序不规范、救济机制不健全等问题，该研究在对发达国家土地征收补偿制度比较研究的基础上，对我国如何在实体正义和程序正义方面完善集体土地征收补偿制度，确保失地农民获得公平合理的补偿，进行了路径分析和探索,以期对我国集体土地征收补偿制度的完善提供启示。
- Abstract:
- The compensation of collective land expropriation is the core issue of land expropriation system.At present,compensation of collective land expropriation in our country exist the problems such as unclear public interest,unreasonable compensation mechanism,as well as improper procedure and relief mechanism.Based on the comparative study of land expropriation compensation system in developed countries,the study gave its analysis and exploration on how to perfect the compensation system of collective land expropriation in our country in terms of substantive justice and procedural justice,to ensure that the farmers who lost their land get a fair and reasonable compensation,in order to provide enlightenment for the improvement of expropriation of collective land compensation system.
